Existing certified nursing assistants will have more than six months from the date of enactment to comply with the new requirement

The NURSING ASSISTANT BACKGROUND CHECK RULE:

  • An existing certified nursing assistant must have a background check performed on or before April 9, 2019, to meet the three-year requirement.
  • The first background check must be done within 6 months of enactment (the date this law goes into effect) and every 2 years thereafter.
  • An employer is prohibited from hiring an applicant for a position as a CNA until the applicant has met all requirements under this law including completion of a criminal history record information background check with fingerprints when required by state law (including expungement).
